TURA, Apr 15: The National People’s Party (NPP) candidate for the Selsella assembly seat by-poll Ferlin CA Sangma has been issued show caused notice by the Election Commission.
There are allegations against Sangma that on April 13 at around 9 pm she was found in Konachar area which falls under Selsella constituency.
“Whereas, your presence in Konachar village on the 13th of April 2019 at around 9 pm falling under the constituency where re-poll has been fixed for the 15th of April 2019, as alleged, can be construed as violation of the Model Code of Conduct and, also invokes provisions laid down under the relevant sections of the Representation of People’s Act,” the returning officer said.
In the show cause notice, the returning officer for the by-poll to the Selsella assembly seat pointed out that on April 13 at approximately, 8:30 pm the Election Commission of India had announced re-poll for Konachar LP School polling both.
The re-poll was necessitated following a mix-up of EVMs for the by-poll and the parliamentary elections which was held on April 11.
The re-poll in this particular polling booth was held on Monday.
According to a complaint filed by the rival Congress, addressed to the returning officer, when villagers found that she was in Konachar area, they asked her to leave. But she did not obliged. Therefore, they complained to the Hallidayganj police station about the matter.
According to the Congress under section 126 of the Representation of People’s Act, 1951, 48 hours before timing of the poll, all the contesting candidates and their other party functionaries are required to leave the constituency area.
According to the Congress by remaining present at Konachar during the prohibited period, Sangma has violated the law.
The NPP candidate from Selsella had till, 7 pm on Monday to reply to the show cause notice.
